When Does a Foreign Company Need a Local MA Holder in Chile?

What international pharmaceutical companies should evaluate before selecting a Chilean marketing authorization holder and defining lifecycle responsibilities.

A holder is a regulatory responsibility, not an address

Foreign product owners often begin with a simple question: who can hold the registration in Chile? The better question is what the proposed holder will be responsible for during the full life of the product.

The model must connect the registration, product rights, manufacturers, authority communications, quality and safety interfaces, lifecycle changes and exit conditions. Treating the holder as a nominal local address leaves essential decisions undefined.

What should be reviewed before acceptance?

A responsible holder decision requires due diligence because the risk continues after the initial filing. The depth of that review should reflect the products, counterparties and intended activities.

  • Product identity, classification and current regulatory status.
  • Ownership, authorization and contractual rights over the dossiers and registrations.
  • Manufacturers, sites, quality interfaces and supply-chain responsibilities.
  • Pharmacovigilance, complaint, recall and escalation arrangements.
  • Pending changes, renewals, commitments and authority correspondence.
  • Decision rights, funding, termination and transfer arrangements.

Separate holder acceptance from service scope

A consultancy can support registration or lifecycle work without automatically accepting the holder role. Holder acceptance should be explicit, documented and subject to satisfactory due diligence, capacity and a separate agreement.

Likewise, recurring lifecycle tasks should be listed in a defined service catalogue or proposal. This avoids assuming that every future variation, renewal or authority interaction is included indefinitely.

Design for continuity and exit

The strongest model explains how information moves between the global product owner and Chile, who approves local decisions, how records remain accessible and what happens if the relationship ends.

A planned transfer and closeout route protects both sides and reduces the risk of orphaned responsibilities.
